Terms and Conditions for BeerMates

Welcome to BeerMates!

These Terms of Service ("Terms") govern your use of the BeerMates platform at https://beermates.top and our mobile applications (collectively, the "Service"). By creating an account or using the Service, you agree to be bound by these Terms.

IF YOU DO NOT AGREE TO THESE TERMS, DO NOT USE THE SERVICE.

1. ABOUT BEERMATES

BeerMates is a location-based social platform that connects beer enthusiasts for spontaneous, real-world meetups at local bars and breweries. We facilitate platonic connections between people who share a love for beer and want to meet new friends in their city.

BeerMates is NOT a dating app. While users are free to pursue romantic connections if mutual interest develops, our platform is designed and marketed for platonic social interactions centered around beer culture.

2. ELIGIBILITY

To use BeerMates, you must:

• Be at least 21 years old (or the legal drinking age in your jurisdiction)
• Provide accurate, current, and complete information during registration
• Complete our identity verification process (selfie liveness check)
• Not be prohibited from using the Service under applicable laws
• Not have been previously banned from BeerMates for violating these Terms

By using the Service, you represent and warrant that you meet all eligibility requirements.

3. ACCOUNT REGISTRATION AND SECURITY

3.1 Account Creation

You must create an account to use BeerMates. You agree to:

• Provide truthful and accurate information (name, age, photos, preferences)
• Use your real identity (no fake profiles or impersonation)
• Maintain only one account per person
• Keep your login credentials secure and confidential
• Notify us immediately of any unauthorized account access

3.2 Identity Verification

All users must complete a selfie verification process to confirm they are real people. Failure to pass verification may result in account suspension or termination.

3.3 Account Termination

You may delete your account at any time through the app settings. We reserve the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or harm the community.

4. USER CONDUCT

You agree NOT to:

• Harass, bully, threaten, or abuse other users
• Use the Service for commercial solicitation or spam
• Create fake profiles or misrepresent your identity, age, or intentions
• Share sexually explicit content or engage in sexual harassment
• Discriminate against others based on race, religion, gender, sexual orientation, disability, or other protected characteristics
• Encourage illegal activity, including underage drinking or substance abuse
• Fail to show up for confirmed meetups repeatedly (no-shows harm community trust)
• Use the Service for romantic or sexual purposes in a deceptive manner (we're not a dating app, but honesty is required)
• Scrape, collect, or harvest user data for any purpose
• Attempt to bypass security features or access restricted areas
• Interfere with the Service's operation or infrastructure
• Violate any applicable laws or regulations

Violation of these rules may result in warnings, account suspension, or permanent ban.

5. USER-GENERATED CONTENT

5.1 Your Content

You retain ownership of content you post (photos, messages, reviews, ratings). By posting content, you grant BeerMates a worldwide, royalty-free license to use, display, reproduce, and distribute your content to operate the Service.

5.2 Content Standards

Your content must not:

• Infringe on intellectual property rights
• Contain false, misleading, or defamatory information
• Include personal information of others without consent
• Be obscene, offensive, or violate community standards

We reserve the right to remove content that violates these Terms or is otherwise objectionable.

5.3 User Ratings and Reviews

Post-meetup ratings and reviews help maintain community quality. Ratings should be honest and based on your actual experience. Fake or malicious reviews are prohibited.

6. LOCATION SERVICES

BeerMates uses your device's location to connect you with nearby users and suggest venues. You can control location permissions through your device settings. Disabling location services will limit core functionality. Your exact location is never shared with other users; we only show approximate distance.

7. MEETUPS AND SAFETY

7.1 Meetup Responsibility

BeerMates facilitates introductions only. We do not organize, supervise, or assume responsibility for in-person meetups. You are solely responsible for your safety and conduct during meetups.

7.2 Safety Guidelines

Always meet in public places (bars, breweries, cafes). Never meet in private residences or isolated areas. Trust your instincts—if something feels wrong, leave immediately. Do not share personal information (home address, financial details) until you feel comfortable. Inform a friend or family member of your plans. Do not drink and drive; use public transit, taxis, or rideshares.

7.3 Risk Acknowledgment

You acknowledge that meeting strangers involves inherent risks. BeerMates does not conduct criminal background checks (beyond basic ID verification). We are not liable for harm, injury, property damage, or other losses resulting from user interactions or meetups.

8. SUBSCRIPTIONS AND PAYMENTS

8.1 Free and Premium Tiers

BeerMates offers a free tier with limited features (10 swipes/day, basic matching) and a Premium subscription ($9.99/month or as updated) with unlimited swipes, SuperCheers, advanced filters, and extra perks.

8.2 Payment Processing

Payments are processed securely through Stripe. By subscribing, you authorize us to charge your payment method on a recurring basis until you cancel.

8.3 Subscription Renewal and Cancellation

Premium subscriptions auto-renew monthly or annually (depending on your plan) unless canceled at least 24 hours before the renewal date. You can cancel anytime through your account settings or app store subscriptions. Cancellation stops future charges but does not refund the current billing period.

8.4 Refund Policy

Free Trial: If offered, you can cancel during the trial period without charge.
Refunds: We do not provide refunds for partial subscription periods. If you cancel mid-month, you retain Premium access until the end of your billing cycle.
Exceptions: Refunds may be granted at our discretion in cases of technical errors, unauthorized charges, or other extenuating circumstances. Contact bartzalewskidev@gmail.com to request a refund.

8.5 Price Changes

We reserve the right to modify subscription prices. Existing subscribers will be notified at least 30 days before price changes take effect. Continued use after notification constitutes acceptance.

9. VENUE PARTNERSHIPS AND COUPONS

BeerMates partners with bars and breweries to offer exclusive deals. Coupons are subject to venue terms and availability. We are not responsible for partner venue policies, service quality, or coupon fulfillment. Venues may change or discontinue offers at any time.

10. INTELLECTUAL PROPERTY

All content on the Service—including text, graphics, logos, software, and features—is owned by BeerMates or its licensors and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our written permission.

11. THIRD-PARTY SERVICES

The Service may contain links to third-party websites or integrate with third-party services (Google OAuth, Stripe, venue partner sites). We are not responsible for third-party content, policies, or practices. Use of third-party services is at your own risk and subject to their terms.

12. DISCLAIMERS AND LIMITATION OF LIABILITY

12.1 Service "As Is"

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT GUARANTEE UNINTERRUPTED, ERROR-FREE, OR SECURE OPERATION. WE DO NOT WARRANT THAT YOU WILL FIND COMPATIBLE MATCHES OR HAVE SUCCESSFUL MEETUPS.

12.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BEERMATES, ITS AFFILIATES, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE, INCLUDING BUT NOT LIMITED TO:

• Harm or injury during meetups
• Loss of data, revenue, or profits
• Property damage or theft
• Emotional distress or reputational harm
• User misconduct or criminal activity

OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR €100, WHICHEVER IS GREATER.

12.3 User Responsibility

You are solely responsible for your interactions with other users and third parties (including venue partners). You release BeerMates from any claims arising from disputes with other users.

13. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless BeerMates, its officers, employees, and affiliates from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any laws or third-party rights
• Content you post on the Service
• Your conduct during meetups

14. DISPUTE RESOLUTION

14.1 Governing Law

These Terms are governed by the laws of Poland, without regard to conflict of law principles. You consent to the exclusive jurisdiction of courts located in Warsaw, Poland for any disputes.

14.2 Informal Resolution

Before filing a legal claim, you agree to contact us at bartzalewskidev@gmail.com to attempt informal resolution. We will work in good faith to resolve disputes amicably.

14.3 Arbitration (Optional)

If required by applicable law, disputes may be resolved through binding arbitration rather than court litigation. Arbitration details will be provided separately if applicable.

15. CHANGES TO THESE TERMS

We may update these Terms from time to time. Significant changes will be communicated via email or in-app notification at least 30 days before taking effect. Continued use of the Service after changes take effect constitutes acceptance. If you do not agree to updated Terms, you must stop using the Service and delete your account.

16. TERMINATION

We reserve the right to suspend or terminate your account at any time, with or without notice, for violations of these Terms or for any reason at our discretion. Upon termination:

• Your access to the Service will cease immediately
• Your data may be deleted in accordance with our Privacy Policy
• Unpaid subscription fees may become immediately due
• Sections of these Terms that by nature should survive (e.g., disclaimers, indemnification) will remain in effect

17. MISCELLANEOUS

17.1 Entire Agreement

These Terms, along with our Privacy Policy, constitute the entire agreement between you and BeerMates.

17.2 Severability

If any provision is found unenforceable, the remaining provisions will remain in full effect.

17.3 No Waiver

Failure to enforce any provision does not constitute a waiver of that provision.

17.4 Assignment

You may not assign or transfer your rights under these Terms. We may assign our rights to any affiliate or successor.
